These Terms and Conditions apply to Session Vouchers and govern the relationship between Kirsten Krupps & Gift Voucher Purchaser/Holder. Purchase/use of your voucher will constitute acceptance of these Terms and Conditions. These Terms and Conditions override any statements on your session voucher if they are different. You must therefore read them carefully. If there is anything you do not understand, please contact me at hello[at]shutterhoundphotos.com. Your session voucher is issued by and remains the property of Kirsten Krupps. It must be kept in a safe place and presented at the time of scheduling your photo session (either by phone picture or in person) in order to receive the benefits of this session voucher. All photo sessions must be scheduled at least 2 weeks in advance and subject to the photographer’s availability.
DEFINITIONS. The Terms “Photographer”, “photography team”, “us”, “we”, and “our” refer to Shutter Hound Pet Photography and all agents, employees, or other representatives.
The term “including” means “including, but not limited to.”
The term “session”, “event”, and “photography session” refers to a hired photographic session for the purposes of taking custom photographs of pets and pets with their people.
The term “gift certificate”, “certificate”, “session voucher”, and “voucher” refers to any prepaid amount to the Photographer for use towards a future photography session.
PAYMENT. Session vouchers must be paid in full at the time of initial inquiry and purchase. Cash, check, Venmo, or an online invoice are the currently accepted forms of payment. Please make checks payable to ‘Kirsten Krupps.’ Returned checks will be subject to an additional $50 fee, and the session voucher will not be valid until payment by cash, online invoice, or Venmo occurs. Credit Card processing fees will be included on all online invoices (2.9% + $0.30) or Venmo (1.9% + $.10). No refunds are permitted for session vouchers.
USING YOUR GIFT CERTIFICATE/VOUCHER: You may redeem your session voucher by calling, emailing, or using the contact form on ShutterHoundPhotos.com. When you use your session voucher the amount of your purchase will be deducted from the balance on the session voucher. The remaining balance may be applied to future purchases. Your session voucher is not a credit certificate, charge certificate, or debit certificate. You may not exchange your session voucher for cash. Session vouchers cannot be used in conjunction with any other vouchers or offers and are non-transferable. You may not sell your session voucher, and it may not be used in sales or promotional activities, including giveaways, or prizes in competitions, without prior consent. Refunds will not be given for the purchase of a session voucher. Photographer reserves the right to refuse to accept session vouchers which Photographer believes may have been stolen or obtained in another illegal way.
EXPIRATION + CANCELLATION: There is an expiration period of one (1) year from the date of issuance applied to your session voucher. However, I reserve the right to cancel your session voucher if I suspect it is being used fraudulently or in breach of the following Terms and Conditions. Session voucher are non-refundable and it is the holder’s responsibility to book their session within good time. It is recommended to contact the photographer to book your session at least 6-8 weeks before your session voucher is due to expire, as the schedule can get booked up well in advance.
LOSS, THEFT, DAMAGE: You should take great care of your session voucher and store it in a safe place until the time of your photo session with Photographer. Photographer is not responsible for lost or stolen session vouchers. You should immediately report any loss, theft, fraudulent or unauthorized use of your session voucher to Photographer immediately. If you lose your session voucher or it is stolen or damaged, Photographer may, at their sole discretion, replace your session voucher and transfer the balance stored on it to a replacement session voucher. Circumstances in which Photographer may determine not to replace your session voucher include where Photographer reasonably believes that the notified incident has been caused by your breach of these Terms and Conditions or where there are reasonable grounds for suspecting that you are or have been engaged in fraudulent or other unlawful conduct. If Photographer agrees to replace your session voucher, a replacement PDF will be sent via email.
RESALE/USE IN PROMOTIONS: You may not sell your session voucher. Session vouchers may not be used in sales or promotional activities, including giveaways or prizes in competitions, without prior consent from Photographer. Photographer reserves the right to cancel any session voucher that Photographer suspects has been resold or obtained in connection with an unauthorized sales or promotional activity.
DATA PROTECTION + PRIVACY: When you use a session voucher you will be asked to provide certain personal information, including your name, address and contact details, as well as signing a contract regarding your photo-session. Photographer is committed to maintaining the security of your personal information in accordance with the requirements of the Data Protection Act and will take all reasonable steps to ensure that your personal data is kept secure against unauthorized access, loss, disclosure, or destruction.
LIABILITY: Photographer shall not be liable for any loss or damage arising from or in connection with your use of a session voucher, where such loss or damage arises from any cause beyond Photographer’s reasonable control. Where any loss or damage arises from a cause within our control, our liability to you shall not exceed a sum equal to the balance on your session voucher, as of the date that such loss or damage occurs. This clause shall not exclude or limit any liability that cannot be excluded or limited by law.
VARIATION: Photographer reserves the right to amend or waive any provision of these Terms and Conditions from time to time or to terminate the session voucher service on reasonable notice. The Terms and Conditions applicable to the use of a session voucher shall be at any time the terms and conditions published Session Vouchers Terms + Conditions (shutterhoundphotos.com) here and your continued use of a session voucher shall constitute your acceptance of such terms and conditions.
REDEMPTION: Session Vouchers are issued for redemption by client, to Photographer in exchange for professional photography services or print products, at the time and place agreed upon and confirmed by client and Photographer. Photo session is by appointment only, subject to photographer availability. All session voucher do not include specific times and/or dates, and are limited by location to within 20 minutes of 78729 Austin, TX, unless otherwise agreed upon by the client and Photographer. Locations that require permits, may incur additional fees above the certificate amount, which must be paid by the client. Session Vouchers cannot be redeemed for cash or returned for a cash refund and cannot be replaced if stolen. Cannot be redeemed to be used or redeemed towards previous purchases or redeemed to purchase other session vouchers, cannot be resold, and are not refundable. Photographer is not responsible for stolen gift certificates/session vouchers and retains the rights to close customer accounts and request alternate forms of payment if a fraudulently obtained gift certificate is redeemed and/or used to make a purchase. Any purchase exceeding the value of a session voucher requires the balance to be paid with a valid credit card, cash, or check, to complete the transaction and receive any additional print products or services not covered by session voucher. Photographer can provide session voucher purchaser with information about the redemption status of gift certificate by request.
EXPIRATION: Session Vouchers issued by Photographer are good for one year of date of issuance/purchase and must be redeemed in full within the valid time period. Any unused balance will not be refunded or credited upon expiry. The session voucher must be shown (either by phone picture, email, or in person) when making a booking to verify that you are the session voucher holder. All bookings will require a signed contract at the time/date of booking by Photographer and client. If session voucher cannot be verified, due to the loss by client of gift session voucher, or proof of voucher holding cannot be obtained, client then forfeits session voucher and Photographer is not held responsible for any amount/services listed on lost session voucher.
PHOTOGRAPHY CONTRACT REQUIRED: All session voucher holders must sign a legally binding photography contract with Photographer, before any photography or print services will be administered. Without contract signed, session voucher holder does not have the rights to any services provided by Photographer, and does not have the right to use session voucher in exchange for any photography or print services, or for any monetary refunds.
CANCELLATION: Session vouchers may be cancelled by Photographer, if after issue, any information supplied at the time of purchase is untrue or inaccurate, or if payment is declined or incorrect cardholder details and/or billing information has been supplied.
MISSED APPOINTMENT: Your gift session voucher entitles you to a single photo-session booking and will be forfeited if you do not attend your appointment. All print credit will be forfeited as well. Rescheduling, and carrying over your session voucher may be considered where (1) more than 48 hours notice is given and only if there is a genuine reason beyond your control, or (2) if a substitute appointment is available. Any such rescheduling is entirely at the sole discretion of Photographer.
REFUSAL OF SERVICE: Photographer may refuse service where provision of services would, in their opinion, negatively effect the workplace rights, safety or well-being of our Staff or Clients, or cause an unreasonable disruption to our normal operations. This includes any issues of abuse or disrespect (whether emotionally or physically) by client towards Photographer. If this happens, then gift certificate/session voucher, print credit and any other offers pertaining to session voucher will be forfeited and withdrawn from client use, and client will not hold Photographer and heirs liable in any way for amount of session voucher. If Client is refused services due to issues stated above, Client then forfeit any rights to gift session voucher, photo session, and print credit offered.
ALL RIGHTS RESERVED: Photographer reserves the right to amend these session voucher terms and conditions from time to time, at their sole discretion. In the event of any dispute, the decision of Photographer is final. All terms and conditions are applicable to the extent permitted by Texas state law.
